Justification for a framework agreement, the duration of which exceeds four years: The planned framework exceeds the normal maximum of 4 years, as contracts for estates maintenance of 5 years are increasingly the norm within the industry. The longer contracts allow sufficient time for the provider to take account of opportunities to deliver efficiencies and thus deliver better value for money. It will also facilitate a more partnership style approach which is core to the NEC3 ethos which will underpin the framework.

Short description of the contract or purchase(s): London Universities Purchasing Consortium (LUPC), a company limited by guarantee reg. no. 04784719, is a not-for-profit company owned by its Members, for its Members. Its primary purpose is to maximise value from the collaborative procurement of goods, services and now works, for over 65 Members, made up of universities and colleges, as well as government agencies, research organisations and museums and other cultural establishments. LUPC (the Authority) is inviting expressions of interest from suitably qualified and experienced providers to tender for the provision of estates maintenance services and minor works to its Member Institutions under a framework agreement. The objective is to ensure Member Institutions receive a service for estates maintenance and minor works projects that is both high quality and value for money. Any other institution that wishes to participate in this framework agreement will only do so via a subsequent membership application accepted by the LUPC. The participating institutions may be subject to change in the future owing to strategic realignment of the Consortium or the inclusion of new full or associate Members, who could be outside the education sector, but within the public sector. The principle behind the framework agreements is that they shall not themselves constitute contracts, but will establish a structure by which orders may be placed by participating institutions, each forming a separate contract under the NEC3 Term Service Contract (TSC) and/or Engineering and Construction Short Contract (ECSC) terms and conditions set out in the framework agreements. Potential providers are required to complete a Pre-Qualification Questionnaire in full. Short-listed potential providers will then be issued the main invitation to tender and be required to provide full details of how they would provide estates maintenance services and/or minor works under the framework.
The contracting authority considers that this Framework Agreement (in particular Lots 2,3,4 and 6) may be suitable for economic operators that are small or medium enterprises (SMEs). For the avoidance of doubt, the Authority points out that no weight will be attached to whether or not an economic operator is an SME in selecting economic operators to submit tenders or in assessing the most economically advantageous tender.
The Framework Agreement will be divided into 6 lots:
Lot 1: Estates Maintenance (large) and Minor Works.
Lot 2: Estates Maintenance (small) and Minor Works.
Lot 3: Mechanical and Electrical Maintenance.
Lot 4: Water Management Services.
Lot 5: Minor Works (large).
Lot 6: Minor Works (small).
Potential providers may express interest in more than 1 lot, however they are restricted to bidding for only 1 lot between Lot 1 and Lot 2, and only 1 lot between Lot 5 and 6. Potential providers interested in Estates Maintenance need to choose if they wish to bid for Lot 1 or Lot 2. Potential providers interested in Minor Works need to decide between Lots 5 and 6. Any potential provider can bid for Lots 3 and 4 regardless of other Lots they have expressed interest in. The Authority plans to award each Lot to a panel of 3 to 5 providers, following the full tender process.
