Whilst it is recognised that other mechanical modelling systems are available. ORE Catapult has invested heavily and standardised on Ansys software over many years, and for compatibility and technical reasons only Ansys software can be used.

Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union
is lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive:
The market strategy deployed by Ansys is done in a very deliberate way to allow customers such as Offshore Renewable Energy Catapult to access the required expertise where and when it is needed, either directly or via strategically located channel partners, as in this instance with Wilde Analysis supporting the Blyth site operations. Indeed, Ansys has worked closely with its partner Wilde Analysis to continue their support role to ORE Catapult, as they have an in-depth understanding of the existing technical requirements and work flows being used at the ORE Catapult test and validation site in Blyth. Therefore competition is absent for technical reasons.
Further, ORE Catapult has, over many years, standardised on Ansys software and whilst other mechanical modelling software is available, there would be significant disruption to the business during the implementation of a new system incurring other internal costs e.g. project management, training, in-depth software knowledge accumulation, migration of the existing drawings.
