II.1.4) Short Description: ESPO is inviting tenders to appoint a range of suppliers onto a framework for the supply and delivery of cleaning materials and janitorial supplies to its customers directly (not via ESPO’s warehouse) on a national basis. The framework will target large, multi-location customers e.g. local authorities, NHS trusts, etc. who require a single supplier to offer a one-stop shop for all of their cleaning material needs.

II.2.4) Description of the procurement:
A national framework for the supply & delivery of cleaning materials and janitorial supplies, including but not limited to, floorcare, washroom, kitchen, laundry and general cleaning chemicals and concentrates, as well as janitorial equipment and paper products.
The framework to be established is intended to meet the requirements of local government and public sector bodies.
ESPO has established a commercial trading company, ESPO Trading Limited, whose target clients are third sector organisations such as national and local charities, public sector mutual organisations and other organisations involved in the delivery of services to or for the public sector. The successful Supplier may be asked to enter into an additional separate framework agreement (the Second Framework) with ESPO Trading Limited on materially similar terms to that found in the tender pack to be entered into by ESPO itself.
Any Second Framework agreement will be a purely commercial agreement and will, for the avoidance of doubt, not be governed by the Public Contract Regulations 2015 or other public procurement legislation. ESPO Trading Limited may enter into the second framework agreement with the successful supplier and make it available to third sector clients who themselves are not required to follow the Public Contracts Regulations 2015 or other public procurement legislation. Accordingly, this is provided for bidders’ information only.

This framework will operate on-going contract monitoring procedures following award, to ensure financial stability requirements are maintained.

Any changes will be assessed (compared with a baseline credit rating score obtained at contract award stage) and significant changes or sustained degradation will be investigated.

ESPO will incorporate a minimum 10 calendar day standstill period at the point information on the award of the contract is communicated to tenderers. Applicants who are unsuccessful shall be informed by ESPO as soon as possible after the decision has been made as to the reasons why the applicant was unsuccessful. If an appeal regarding the award of the contract has not been successfully resolved, The Public Contracts Regulations 2015 (SI 2105 No. 102) provide for aggrieved parties who have been harmed or are at risk of harm by breach of the rules to take legal action. Any such action must be brought within the applicable limitation period. Where a contract has not been entered into, the Court may order the setting aside of the award decision or order for any document to be amended and may award damages, make a declaration of ineffectiveness, order for a fine to be paid, and/or order the duration of the contract be shortened. The purpose of the standstill period referred to above is to allow the parties to apply to the Courts to set aside the award decision before the contract is entered into.
