The procurement falls outside the scope of application of the directive

3.Explanation
Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union
is lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive:
The non exclusive contract will be awarded to the supplying organisation due to the fact that no other UK source of supply is available that has the support and direct supply from the Original Equipment Manufacturer. The only alternative source would be to buy directly from Honeywell in Germany who do not carry shelf stock of the associated parts and only make to order, thus significant lead times apply which can hinder NGN in the delivery of its objectives.
