Short description of the contract or purchase(s): The Royal Borough of Kensington and Chelsea (the Contracting Authority) is putting in place an agreement for mechanisms to access and gain network connectivity and telecommunication services including services over the Public Services Network (PSN) for use by or on behalf of the UK public sector bodies listed at I.2 (and any future successors to these organisations). Although the Royal Borough of Kensington and Chelsea is named as contracting authority in this contract notice, any one of the Royal Borough of Kensington and Chelsea, London Borough of Hammersmith and Fulham or Westminster City Council, may ultimately enter into the framework agreement.
For the avoidance of doubt, the framework agreement will be open to the following public sector bodies in Greater London (but excluding Government Departments) and any statutory successors to and organisations created, merged or absorbed as a result of re-organisation of or organisational changes affecting such bodies. This will include but not be limited to:
1) Local authorities in Greater London i.e. a local authority as defined in Regulation 3(2) of the Public Contracts Regulations 2006 (the Regulations):
Barking and Dagenham, Barnet, Bexley, Brent, Bromley, City of London, Croydon, Ealing, Enfield, Greenwich, Hammersmith and Fulham, Haringey, Hillingdon, Havering, Islington, Hounslow, Lambeth, Lewisham, Merton, Newham, Redbridge, Richmond upon Thames, Royal Borough of Kensington and Chelsea, Royal Borough of Kingston upon Thames, Southwark, Sutton, Tower Hamlets, Waltham Forest, Wandsworth, Westminster City Council;
2) Greater London Authority Group including but not limited to Transport for London, London Fire and Emergency Planning Association, (London Fire Brigade), Mayor’s Office for Policing and Crime, Royal Parks and any subsequent body included in the GLA group;
3) Police services in Greater London (i.e. police authorities, and the Metropolitan Police Authority/Service as defined by Regulations 3 (1) (j) (k) (n) and (m) of the Regulations);
4) Educational establishments in Greater London i.e. schools (maintained and academies), school governing bodies; voluntary aided schools; foundation schools; any faith educational establishments including the Roman Catholic Dioceses and Anglican Dioceses, associated with the named Local Authorities including diocesan authorities; academies and free schools;
5) All Registered Providers of Social Housing in Greater London including but not limited to Registered Providers of Social Housing (as defined in the Housing and Regeneration Act 2008), Tenant Management Organisations (TMOs) and their agents within the geographical area of Greater London including all Arms Length Management Organisations (ALMO’s) or any successor body of the Local Authorities within Greater London. This also includes CityWest Homes;
6) NHS establishments in Greater London and Primary Care Trusts associated with the Local Authorities;
7) Trusts, Social Enterprises, Mutuals, and Community Interest Companies (i.e. organisations that have been established by the public bodies within the scope of this advertisement and/or where the contracting public bodies are trustees or partners of the Trusts, Social Enterprises, Mutuals and Community Interest Companies or any similar organisation);
8) Other Public Sector Organisations:
London Waste Authorities, Local Government Association and The Electoral Commission.
The above public sector bodies have a need for the provision of innovative network connectivity, telecommunications and other services, including PSN compliant services and non-PSN compliant services, to facilitate inter-organisational collaboration through secure communication, interoperability and sharing of information. The services to be made available under the Framework Agreement will include data access services; local connectivity services; traditional telephony services; inbound telephony services; IP-telephony solutions; mobile, voice and data services; paging services; video conferencing; audio conferencing; and integrated communications services, including, but not limited to, networks, corporate and guest Wi-Fi, gateways and related services; voice lines and minute bundles; mobile services including voice and data, pager services; email services; internet service provision, content filtering services and intruder detection systems; communication services including video and audio conferencing services, and unified communications; call centre services; and associated supporting services including but not limited to security, information assurance, design/build/operate consultancy, acquisition, technology audit and site surveys; innovation and exploitation of new and emerging technologies and products, management and support, agency and professional services, and other services as described in this OJEU notice; the framework agreement; the call off terms; and the call off order form.
The contracting authority considers that this procurement may be suitable for economic operators that are Small or Medium Enterprises (SMEs). For the avoidance of doubt, the contracting authority points out that no weight will be attached to whether or not an economic operator is an SME in assessing the most economically advantageous tender.
The framework agreement will have an initial term of four (4) years. The duration of call-off contracts placed under this framework agreement will be for a maximum of seven (7) years comprising an initial term of four (4) years with an option to extend by three (3) further periods of one (1) year.
The framework agreement will need potential providers with the ability to deliver central services (which are services essential to support the functional operation of a services network and might include but not be limited to a top level domain name service and public key infrastructure) which must be assured and accredited to the appropriate security level as specified, by contracting bodies that will award specific contracts under the framework agreement as the individual data owners.
Each potential provider intending to deliver PSN compliant services under the framework agreement will need to be capable of supplying PSN compliant services to the required security level as specified, by contracting bodies that will award specific contracts under the framework agreement as the individual data owners.
The sustainability of services offered under the framework agreement will be a component part in reducing contracting Bodies’ carbon footprints, not only in energy consumption but also in enabling further wider reduction in sustainability impacts. In addition, the sustainability of potential providers’ sources of supply should be a key consideration. As such, sustainability will be a common theme throughout the lifetime of the framework agreement and the specific contracts awarded under it.
Public Services Network (PSN): Public Services Network is a secure network built to common standards that enables the delivery of public services from any place by any provider. In doing so it creates a competitive marketplace to significantly reduce the cost of telecommunications services and enable different and creative ways of delivering public services.
Potential Providers are strongly encouraged to become familiar with the PSN concepts, principles, operation and standards, and in particular to read the PSN operating model for an overview of the PSN and its operating principles, and to visit the PSN website: Where successful potential providers deliver PSN compliant services they will be required to ensure that the services comply with the PSN standards, as published during the procurement and during the lifetime of the framework agreement and any specific contracts awarded under it provided that any new standards published post award do not materially alter the scope of the services as set out in this OJEU notice, the framework agreement and any specific contracts awarded under the framework agreements.
The contracting authority has taken in to account and abided by the Public Services (Social Value) Act 2012 in carrying out this procurement.
