Short description of the contract or purchase(s): The Tender submission should consider a broad and comprehensive service comprising of the following:
Drafting filing and prosecution of patent applications in a wide range of technical disciplines including, but not limited to, biotechnology, pharmacology, chemistry and material science, radiation, engineering, IT and software. The area of expertise must include detailed technical and IP experience that closely fits with PHE’s research areas including vaccines, diagnostics, detection and screening areas.
Drafting, filing and prosecution of trademarks in the above areas, as well as in public health, training and other areas of PHE’s activities.
Provision of advice on IP strategies to develop optimal and cost-effective patent and trade-mark portfolios to protect PHE IP.
Provision of advice and support where necessary to defend patents and trademarks from attack or infringement.
Note – PHE is required to balance IP protection with the need to publish promptly. This means that occasionally instructions may be provided to our agents at short notice. The successful agent will be expected to be available to draft and file patent applications and provide intellectual property advice potentially at short notice (occasionally less than 48 hours) and will be expected to provide a reasonably fast turnaround time for all work that is instructed.
Given the foregoing, please provide evidence that demonstrates your company’s capabilities in the following areas:
Provision of timely reminders of patent deadlines. The tenderer is also expected to provide information on how renewal fees matters are handled (e.g. use of third party annuity services)
Trademark searches, filing and maintenance
Provision of efficient management of renewals
Advising on patent infringement & validity
Instruction of overseas attorneys
Intellectual property monitoring & searching
Handling of cases transferred from other agents
All day attendance and active participation at one-to-one meetings with inventors and business colleagues and monthly Intellectual Property Sub-group (IPSG) meetings. This involves valuable feedback to IPSG on prosecution issues, recommendations for filing of new disclosures.
