II.1.4) Short Description: Telford & Wrekin Council is remodelling the way that services classed as “Long Term Supported Accommodation” (LTSA) are purchased. The principle behind LTSA is that the separate elements (categories) of the whole service are recognised and an approach is developed to allow these to be accessed separately and combined flexibly. The overall aim is to develop more person centred services, and reflect an outcome focussed commissioning approach.
Services included under LTSA are those in which;
•There is some form of accommodation/housing;
•There is some type of care and/or support services; and
•These service elements are long term (individual can remain for life or until choose to move).
The aim of all LTSA is to keep people as independent, healthy and well as they can be. Over 85% of the services that Adult Social Care purchase can be defined as LTSA.

3. Explanation
Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union is
lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive: (500 words maximum)
The contracting authority considers it is acting lawfully, and considers that it is justified in its view that it is not required to publish a contract notice in the Official Journal of the European Union, as in the opinion of the contracting authority, the intended modifications to the contract(s) during their respective terms, (as listed below) are permissible under Article 72(c) of Directive 2014/24/EU, as transcribed and implemented into UK law, specifically under Regulation 72 (1) (c) (i-iii) of the Public Contracts Regulations 2015 (the “Regulations”).
It is the contracting authority’s case that the said modifications, inclusive of extension of the contract term in some cases to allow an organised transition onto the proposed Dynamic Purchasing System, do not alter the overall nature or scope of any of the contracts, as the contracting authority will effectively continue to perform the services described in the original contract notice and procurement documents, nor result in any increase in the original contract price and that the need for the modifications has been brought about by events unforeseeable by the contracting authority.
The required modifications were not foreseeable because by its nature the service being provided under the contract(s) is continually evolving and needs to be reviewed and remodelled to ensure fitness for purpose in the interests and safety of service users. In addition the requirements of the Care Act 2014 (implemented on the 1st April 2015) requires that local authorities must provide (or arrange) services that help to prevent people unnecessarily developing needs for care and support, or delay any deterioration people’s health to negate or reduce the need for on-going care, coupled with the need for the delivery of more personalised services. The proposed contract modifications will also afford the contracting authority the necessary time to move from a traditional, and less personalised block contracting arrangements, to a more personalised model which will ultimately be procured via a Dynamic Purchasing System which the contracting authority is in the process of implementing under Regulation 34 of the Regulations.
