The award of this contract is compliant with PCR 2015 32.2(a) use of the negotiated procedure without prior publication on the following grounds; a) where no tenders, no suitable tenders, no requests to participate or no suitable requests to participate have been submitted in response to an open procedure or a restricted procedure, provided that the initial conditions of the contract are not substantially altered and that a report is sent to the Commission where it so requests. The requirement to let this contract has arisen due to the failure of an open tender competition to make an award. No compliant bids were received and the Authority are currently undertaking a re-tender process. This contract will allow for the supply and delivery of Grab and Go Food Products to school kitchens until the end of this academic year i.e. 30 June 2023. EANI intends to run a new tender process and it is anticipated that this will be in place by September 2023.
