Justification for the award of the contract without prior publication of a call for
competition in the Official Journal of the European Union

3.Explanation
Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union
is lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive:
The Air Commodities Team, part of the UK Ministry of Defence (MoD), intends to award a contract to Smiths Detection — Watford Limited in order to award a 180 month contract (made up of initial 60 month contract and 2 addition 60 month contract options) for the manufacture and in-service support of Security Screening Equipment commencing in September 2016.
It is considered that his contract can be awarded using the negotiated procedure without prior publication of a contract notice pursuant to Article 28(1)(a) of the Directive 2009/81/EC of the European Parliament and of the Council (Regulation 16(1)(a)(i) of the UK Defence and Security Public Contracts Regulations 2011 (DSPCR)). This is because there were no suitable tenders in response to an Accelerated Restricted Procedure and the terms of the proposed contract offered in the discontinued procedure will not be substantially altered in the negotiated procedure.
