The Authority requires Diesel fuel (DIESO MT (NATO Code F-54) complying with BS EN 590 (latest issue)) to be supplied into the Authority’s Bulk Fuel Carrying Vehicles (BFCVs) or Deployable Bulk Fuel Installations (DBFIs) in order to provide fuel support to military exercises. It is anticipated that the requirement for filling the Authority’s vehicles will be met by the supplier’s vehicles delivering fuel directly into the Authority’s vehicles at a site that offers suitable security, accessibility and environmental protection.

II.2.4) Description of the procurement

The Authority will not enter into a Contract until the VTN has been published and available for review for a minimum of 10 days.
Subject to negotiation outcome, the deadline for Invitation to Negotiation (ITN) documents should be returned by 22 March 2021. The ITN will be reviewed by both a Commercial and Project team on the 26 March 2021 who will provide their confirmations before 29 March 2021. The Contract should then be placed on the 29 March 2021 – depending on this VTN outcome and review outcome.

3.Explanation
Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union
is lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive:
The Defence Fuels Acquisition Programme (DFAP) intends to place a Contract with Certas UK Ltd for the Provision of Ground Fuel (Diesel) to fulfil Army training requirements, using the negotiated procedure without prior publication. The contract will run for a period of two (2) firm years and one (1) option year and is valued at approximately GBP 1.3 million.
On 16 January 2021 DFAP advertised a contract notice indicating a call for competition for this requirement. Responses to the call for competition were required by 16 February 2021. No responses were received to the call for competition. Given no tenders were submitted in response to the competitive procedure, DFAP intends to place this contract pursuant to Regulation 32(2)(a) of the Public Contracts Regulations 2015.
