in the Official Journal of the European Union
The procurement falls outside the scope of application of the directive
3.Explanation
Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union
is lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive:
The selected supplier, Kodak Alaris Limited, is the authorised IBML reseller and service agent for the territory of United Kingdom (& wider EMEA Europe, Middle East & Africa region).
Section 5b of the PCR 2015 states that:
The negotiated procedure without prior publication may be used for public supply contracts for additional deliveries by the original supplier which are intended either as a partial replacement of supplies or installations or as the extension of existing supplies or installations where a change of supplier would oblige the contracting authority to acquire supplies having different technical characteristics which would result in incompatibility or disproportionate technical difficulties in operation and maintenance.
In this case, the replacement of the scanners from an alternative source would be subject to technical and economic risks including but not limited to the reconfiguration of hardware and software elements as well as business continuity.
