Justification for the award of the contract without prior publication of a call for

The works, supplies or services can be provided only by a particular economic operator for the following reason:
absence of competition for technical reasons

Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union
is lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive:
Reg. 32(2)(b)(ii) – The Trust is not aware of any other provider capable of providing this tailored service. EIDO Healthcare supply patient information leaflets specifically designed for health care providers. They also allow for local customisation for the Trust to enable us to customise the leaflets for all our respective hospital sites. Translation services are also available. The Trust is citing Reg 32(2)(b)(ii) on the basis that competition is absent as no other supplier is currently capable of providing this service.
