This contract relates to the provision of proprietary equipment and associated maintenance
relative to NGN’s odorant injection system. The original contract was awarded in 2012 for
ongoing maintenance support. Following the initial term various extensions have been put in place by way of contract variations along with subsequent purchase of additional proprietary
equipment used to replace equipment which due to age is no longer serviceable. The total
contract value is now above threshold and as such this notice is being issued.

(1) Utilities may use the negotiated procedure without prior call for competition in the
following cases- (e) in the case of supply contracts for additional deliveries by the original
supplier which are intended either as a partial replacement of supplies or installations or as
the extension of existing supplies or installations, where a change of supplier would oblige
the utility to acquire supplies having different technical characteristics which would result in
incompatibility or disproportionate technical difficulties in operation and maintenance.
