The works/goods/services can be provided only by a particular tenderer for reasons that are: technical, connected with the protection of exclusive rights
King’s College London has been working with other Research partners including University of Bristol and the 5G Innovation Centre, University of Surrey, to contribute to the 5G Hub end-to-end capability trial research project sponsored by the Department of Culture, Media and Sport (DCMS). The project was expected to be announced in April 2017, but due to the calling of a General Election by the Government in power, a period of purdah was announced which delayed the decision and award of research funding until after a new Government and Minister was installed. This unforeseeable delay in the commencement of the project, together with a fixed end date for the trial has squeezed the project time-line to such an extent that there is now an extreme urgency in awarding contracts for supplies and services required for a successful participation in the trial. In addition to this justification on the grounds of extreme urgency, the trial equipment will integrate with and extend existing laboratory equipment supplied by Ericsson within the Department for Informatics, Faculty of Natural and Mathematical Sciences at King’s College London. Ericsson have exclusive rights in some of this existing equipment, and there is further justification for the award of this contract without prior publication of a contract notice on technical grounds and in connection with the protection of those exclusive rights.
