Justification for the choice of the negotiated procedure without prior publication of a contract notice in the OJEU in accordance with Directive 2004/18/EC
The works/goods/services can be provided only by a particular tenderer for reasons that are: technical,
Quality Assessment Standards for Fetal Screening Services require all laboratories to be able to provide a continual service, therefore it is essential for equipment to be up to date. A 2nd instrument is required to offer a resilient service.
Nottingham University Hospitals NHS Trust is the only Trust in the UK to offer fully electronic reporting for Trisomy Screening allowing community midwives across Leicestershire, Nottinghamshire and Lincolnshire access to test results the day they are produced. The system also automatically sends NUH specific letters to low risk ladies. This relies on the Life-cycle software provided by Perkin Elmer with the analysers. Considerable investment has been made by the Trust to interface with the LIMS in use and NUH and University Hospitals of Leicester NHS Trust. The Risk Calculation software is linked specifically to this analytical platform and as such any change would require considerable expense and training both within the Trust and the wider communities in Nottinghamshire, Lincolnshire and Leicestershire.
Any change of provider has been highlighted by the Fetal Anomaly Screening Program (commissioned by Public Health England) as a significant risk in a recent inspection.
The Trust believes that Perkin Elmer are the only supplier to be able to provide the range of instrumentation and software required to maintain this level of service.
