NTL operates 10 class 158/9s which are leased from Eversholt Rail. As to ensure these can be operated, NTL are required to procure bogie overhauls in line with the maintenance regime along with ongoing repairs caused through wear and tear out in traffic.
Eversholt do not hold a float of bogies to support an overhaul programme therefore it is agreed between Eversholt and Porterbrook that Northern utilise the Porterbrook float to support the bogie overhauls on the 158/9s until the end of the fleets expected life cycle. Porterbrook have an agreed contract with Pullman Rail for the management of all Porterbrook-owned Cl158 bogies. As such it is required that NTL has an agreement in place for the overhaul of the 158/9 bogies with Pullman.

in the Official Journal of the European Union
The procurement falls outside the scope of application of the directive

3.Explanation
Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union
is lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive:
NTL operates 10 class 158/9s which are leased from Eversholt Rail. So that these can be operated NTL are required to procure bogie overhauls in line with the ROSCOs specification which dictates the necessary maintenance regime. As to ensure compliance and the timely overhaul & maintenance regime for the 158/9 fleet it is necessary that Northern has access to the ROSCO’s float. Eversholt do not hold a float of bogies to support an overhaul programme therefore it is agreed between Eversholt and Porterbrook that Northern are required to utilise the Porterbrook float to support the bogie overhauls. Porterbrook have an agreed contract with Pullman Rail for the management of all Porterbrook-owned Cl158 bogies. As such it is required that NTL has an agreement in place for the overhaul of the 158/9 bogies with Pullman.
