Leakage repair sealants are widely utilised within the NGN operational network to repair mains gas pipes. The current contract expires shortly but due to the new BSI standards being in the early stages of use, a new tender event has not been undertaken to allow time for NGN to understand the best approach to leakage repair sealants to allow for a meaningful tender event to take place in circa 6-7 months time. Therefor NGN are seeking to extend the current contract that’s in place with multiple suppliers for a 13 month period, until the new tender is complete and awarded.

Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union
is lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive:
NGN are unable to award the contract at present as the British Standards Institution (BSI) have only just published some of the standards for the correct products and methods of leakage repair application, NGN require time and consultation to understand the new standards to allow for a meaningful and robust tender strategy/scope to be written.
